Terms of Service

Effective April 17, 2026

These terms govern the use of the Fitwear app (the "Service"). By signing up and using the app, you confirm that you have read and agree to these terms.

1.What the Service does

Fitwear provides AI-powered virtual try-on of clothing using your photos. It includes:

• uploading body scan photos to use as your "silhouette";
• uploading clothing photos into your personal wardrobe;
• generating virtual try-on images;
• creating and saving outfit capsules for various occasions (work, casual, evening, etc.).

2.Who can use it

The Service is for adult users (18+). By signing up, you confirm that:

• you are at least 18 years old;
• you have the legal capacity to enter into agreements;
• you are not in a country where the Service is prohibited.

3.What you can and cannot do

Allowed:

• upload only your own photographs;
• upload clothing photos you have rights to (or catalog photos for personal use);
• save and share generated results for personal purposes.

Not allowed:

• upload photos of other people without their explicit consent;
• upload photos of minors;
• upload nude photographs or content that violates community standards;
• attempt to bypass moderation (NSFW guard, content filters);
• use the Service to create deepfakes, misinformation, harassment or other illegal purposes;
• attempt to hack, reverse-engineer, scrape or otherwise disrupt the Service;
• use automated mass-request tools (rate limit + risk score apply automatically).

4.Content & Intellectual Property

You retain all rights to photos you upload and results generated from them. By uploading, you grant us a non-exclusive license to store, process and display that content to you within the Service. We do not use your content to train third-party models or share it in non-aggregated form.

The Service, its design, code, and trademarks belong to the rights holder and are protected by intellectual property law.

5.Limitation of liability

The Service is provided "as is". We make reasonable efforts for:

• service uptime;
• protecting your data;
• accuracy of the virtual try-on.

However, virtual try-on is an AI prediction, and the result may differ from the real look of the clothing on you. We do not warrant that clothing will fit in real life and are not liable for purchase decisions based on try-on results.

Maximum service liability to you is limited to the amount you paid for the Service in the last 12 months (for free users — $0).

6.Subscription, payment and refunds

The Service offers paid subscriptions (Lite, Pro) with monthly or yearly billing. Prices, period and features of each tier are shown on the in-app paywall and in the App Store. The price for your region is determined by Apple at the time of purchase.

Auto-renewal:

• Your subscription automatically renews 24 hours before the current period ends at the same price unless you cancel beforehand.
• You manage and cancel your subscription through your Apple ID settings: Settings → [Your name] → Subscriptions → Fitwear → Cancel Subscription.
• After cancellation, access to paid features remains until the end of the paid period.

Free trial:

• If a free trial (e.g., 7 days) is offered, it starts at the time of purchase. To avoid being charged, cancel at least 24 hours before the trial period ends.
• Apple may restrict eligibility for the free trial (one per subscription group per Apple ID).

Refunds:

• Payments and refunds are handled by Apple under their refund policy. Refund requests are submitted via reportaproblem.apple.com.
• We do not have the technical ability to issue refunds for App Store payments directly.
• If Apple issues a refund, we may correspondingly restrict or terminate access to paid features.

Price or feature changes:

• If the price of an active subscription increases, we will notify you at least 30 days in advance through the app and/or email. If you disagree with the new price, cancel the subscription before the change takes effect.
• Feature quotas (try-ons, AI photos, etc.) may change over time. We will give advance notice of any material decrease in limits using the same channels.

7.Termination

You may stop using the Service at any time by deleting your account (see Privacy Policy, § 7). Deleting your account does NOT automatically cancel your auto-renewing subscription — cancel it separately through your Apple ID settings (see § 6).

We may suspend or delete your account if:

• you violate these terms;
• your account is inactive for more than 24 months;
• required by an order of a competent authority.

8.Changes

We may update these terms. For material changes we'll notify you via the app or email at least 14 days before the changes take effect. Continued use after the effective date means you accept the changes.

9.Governing law and jurisdiction

These terms are governed by the laws of the Republic of Armenia, where the rights holder is registered. Disputes are first to be resolved by good-faith negotiation. If negotiation fails, disputes are subject to the jurisdiction of the courts of the Republic of Armenia.

EU consumer carve-out: if you are a consumer resident in the European Union or the United Kingdom, mandatory provisions of your country's consumer-protection law apply notwithstanding the choice of governing law above, and you may bring claims before the courts of your habitual residence.

Russian Federation users: these terms apply alongside the Russian-language version (terms.html) and additional consumer-protection provisions of Russian Federation law where mandatory.
